Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "user") and Axxion Wallet ("Axxion", "we", "our", "us"). By downloading, installing, accessing, or using the Axxion Wallet mobile application, web application, or any related services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into a binding contract to use the Service. You represent that you are not located in, under the control of, or a resident of any country or region subject to a comprehensive sanctions program of the United States, the United Kingdom, the European Union, or the United Nations, and that you are not listed on any U.S. government prohibited or restricted-party list.

2. Nature of the Service — Non-Custodial Software

Axxion Wallet is a non-custodial, self-custody software wallet. We do not hold, control, or have access to your private keys, seed phrases, funds, or digital assets. All transactions are initiated by you and broadcast to third-party public blockchains. We are a software provider, not a bank, broker-dealer, exchange, money-services business, or financial adviser, and we do not offer investment advice.

3. Your Wallet, Your Responsibility

You are solely responsible for (a) generating, storing, and safeguarding your recovery phrase, private keys, and passcodes; (b) all activity in your wallet; (c) verifying the accuracy of every transaction before you sign it; and (d) any losses arising from lost or compromised credentials. If you lose your recovery phrase, we cannot restore access to your wallet or your assets.

4. Acceptable Use

You agree not to use the Service to:

• violate any applicable law, regulation, or third-party right;
• engage in money laundering, terrorist financing, fraud, or sanctions evasion;
• interfere with, disrupt, or reverse-engineer the Service or its infrastructure;
• upload malware or attempt to gain unauthorized access to any system;
• impersonate any person or misrepresent your affiliation with anyone.

5. Third-Party Services, Networks, and dApps

The Service may allow you to connect to public blockchains, decentralized applications ("dApps"), bridges, swap aggregators, price feeds, and other third-party services. These are operated by independent third parties, not by Axxion. We do not endorse, control, or guarantee any third-party service, and we are not responsible for any loss arising from your use of them. You are responsible for reviewing each third party's own terms.

6. Fees, Slippage, and Network Costs

You are responsible for all network (gas) fees and any protocol fees charged by third-party liquidity providers or bridges. Displayed quotes are estimates and may change due to network conditions and slippage between quote and execution.

7. Risk Disclosure

Digital assets are highly volatile and speculative. You may lose some or all of the value of any asset you hold or trade. Blockchain transactions are irreversible. Smart contracts may contain bugs. Regulatory treatment of digital assets is uncertain and evolving. You represent that you understand these risks and accept sole responsibility for your use of the Service.

8. No Investment Advice

Content in the Service — including prices, charts, and market data — is provided for informational purposes only and does not constitute financial, investment, tax, legal, or other professional advice. Consult a qualified adviser before making any financial decision.

9. Intellectual Property

Axxion, the Axxion logo, and all related marks are our trademarks. All software, designs, and content in the Service are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

10. Availability, Modification, and Termination

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may terminate or restrict your access if we reasonably believe you have violated these Terms or if required by law. Because the Service is non-custodial, your assets remain accessible using your recovery phrase in any compatible wallet.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR DIGITAL ASSETS, ARISING FROM OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

13. Indemnification

You agree to indemnify and hold harmless Axxion, its affiliates, and their officers, directors, employees, and agents from any claim or demand arising from your use of the Service or your breach of these Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-laws principles. Any dispute will be resolved by binding arbitration on an individual basis, and you waive any right to a class action or jury trial, except where prohibited by law.

15. Apple App Store and Google Play Additional Terms

If you obtained the app through the Apple App Store or Google Play, you acknowledge that these Terms are between you and Axxion, not Apple or Google, and that Apple and Google are not responsible for the Service or its content. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in-app or by other reasonable means. Your continued use after changes take effect constitutes acceptance.
